MTB TRAILRADAR — TERMS OF USE
Last updated: October 9, 2026
These Terms of Use govern your access to and use of the MTB TrailRadar application.
By downloading, accessing, purchasing a subscription through, or using MTB TrailRadar, you agree to these Terms.
If you do not agree to these Terms, do not use the application.
1. Service Provider
MTB TrailRadar is provided by:
VIDA LILIANA
Operating under the name FurboTech Labs
Italian sole proprietorship (Italy)
Business address (tax domicile): Via Cormons 26, Corona, Mariano del Friuli (GO), Italy
Email: support@furbotechlabs.com
In these Terms, “MTB TrailRadar,” “we,” “us” and “our” refer to the person or entity identified above.
2. Relationship with Apple
MTB TrailRadar is distributed through Apple’s App Store.
Your use of the application is also subject to:
Apple’s applicable App Store terms;
Apple’s Media Services Terms and Conditions;
Apple’s Standard Licensed Application End User License Agreement, unless another valid end-user licence agreement is expressly provided.
These Terms supplement the applicable Apple terms and do not replace any mandatory rights or obligations imposed by Apple or applicable law.
Apple is not responsible for providing maintenance or support for MTB TrailRadar except where required under Apple’s own terms.
3. Purpose of the Application
MTB TrailRadar is a mountain-biking planning and maintenance utility designed to help users:
evaluate estimated trail conditions;
compare trail areas;
plan potential rides;
organize bikes and other supported vehicles;
record maintenance information;
manage checklists, reminders and related riding information.
The application provides informational results derived from available weather data, trail characteristics, user selections and proprietary scoring logic.
MTB TrailRadar is a decision-support tool only.
It does not guarantee:
actual trail conditions;
trail availability;
legal access;
weather accuracy;
rider safety;
suitability for a particular rider;
the quality or outcome of a ride.
4. No Professional or Safety Advice
Information displayed by MTB TrailRadar is provided for general informational and planning purposes.
It is not:
professional safety advice;
medical advice;
emergency information;
legal advice;
official trail-management information;
a substitute for local warnings or personal judgement.
Users must independently verify all information relevant to a ride.
5. Rider Responsibility
Users are solely responsible for deciding whether, where, when and how to ride.
Before riding, users should independently evaluate:
current trail conditions;
current and forecast weather;
official warnings;
trail closures;
local access restrictions;
landowner or trail-manager requirements;
their personal skill and fitness level;
equipment condition and suitability;
daylight, visibility and emergency arrangements.
The appearance of a trail area within MTB TrailRadar does not mean that the area is open, publicly accessible, legally rideable, maintained or safe.
Users must comply with all applicable laws, regulations, signs, closures and local trail rules.
6. Trail and Weather Estimates
Trail conditions may change rapidly because of:
rainfall;
temperature;
humidity;
snow or ice;
trail maintenance;
erosion;
natural events;
local use;
drainage;
terrain characteristics;
circumstances not available to the application.
Scores, rankings, forecasts, labels and recommendations provided by MTB TrailRadar are estimates.
Actual conditions may differ materially from those displayed.
MTB TrailRadar obtains weather information through Apple WeatherKit. Weather data and forecasts may be delayed, incomplete, unavailable or inaccurate.
YOUR USE OF THIS REAL TIME WEATHER GUIDANCE APPLICATION OR WEBSITE IS AT YOUR SOLE RISK. WEATHER DATA MAY NOT BE ACCURATE.
Apple Weather Data may vary from actual conditions due to variable factors, such as signal issues and geopolitical events, that can affect the accuracy of Apple Weather Data.
Users should not rely on MTB TrailRadar as their only source of weather, safety or access information.
7. Outdoor Activity Risks
Mountain biking and other outdoor activities involve inherent and potentially serious risks.
These risks may include:
falls;
collisions;
changing weather;
reduced visibility;
natural or artificial obstacles;
loose or unstable surfaces;
equipment failure;
encounters with vehicles, animals or other trail users;
injury;
property damage;
serious bodily harm or death.
By choosing to participate in a riding activity, users acknowledge the inherent risks and remain responsible for their own conduct, preparation, equipment and decisions.
Nothing in MTB TrailRadar should be interpreted as an assurance that an activity is free from risk.
8. Emergency Situations
MTB TrailRadar is not an emergency or rescue service.
The app must not be relied upon to:
contact emergency services;
transmit the user’s location to rescuers;
monitor rider safety;
guarantee mobile or internet coverage;
provide real-time hazard warnings.
In an emergency, users should contact the appropriate local emergency services using an available telephone or emergency communication device.
9. User-Created Content
Users may create or store information including:
custom trail areas;
notes;
favourite locations;
bikes and vehicles;
ride logs;
maintenance records;
checklist information;
replacement-part inventories;
suspension settings;
reminders and preferences.
Users are responsible for:
the accuracy of their content;
maintaining appropriate backups;
avoiding unlawful, harmful or infringing content;
ensuring that personal trail areas do not violate access restrictions or third-party rights.
User-created content is generally stored locally on the device.
We do not guarantee that locally stored information can be recovered following:
deletion;
device loss or failure;
app removal;
operating-system changes;
backup failure;
data corruption;
device restoration.
10. Free Features
MTB TrailRadar may provide functionality that can be used without a Premium subscription.
The availability and scope of free functionality may evolve as the application is updated.
Any change will remain subject to applicable law and will not remove rights already acquired by users where such removal would be prohibited.
11. Premium Subscription
MTB TrailRadar offers an optional auto-renewable Premium subscription through Apple’s App Store.
The Premium subscription may provide access to features such as:
Premium TrailRadar analysis and planning functionality;
Premium trail-condition analysis;
Best Rides and ranking tools;
additional Garage functionality;
higher or unlimited limits for supported items;
other features identified as Premium within the app or App Store product description.
The exact functionality included in Premium is displayed within the application before purchase. Premium charges cover value-added app features and analyses; they do not sell or sublicense Apple Weather Data in its original form.
Premium access remains active for the applicable subscription period, subject to successful payment, Apple’s subscription status and these Terms.
Updates or improvements may be added to the Premium tier over time. These Terms do not guarantee that every future feature, product or service will be included in the same subscription.
12. Subscription Duration and Price
Premium is offered through optional monthly and annual auto-renewable subscriptions purchased through Apple StoreKit.
The current price, currency, billing period and any applicable taxes are displayed through Apple before the user confirms the purchase.
Prices may vary according to:
the user’s App Store country or region;
local currency;
taxes;
pricing changes permitted and communicated through Apple.
The total amount charged for the selected monthly or annual subscription is the localized amount displayed in Apple’s purchase interface at the time of purchase or renewal.
13. Radar Access Window and Introductory Offers
MTB TrailRadar may provide a separate 168-hour Radar access window calculated from the original app purchase date in a verified Apple AppTransaction. This access window is controlled by the app and does not itself start an Apple subscription, unlock all Premium features or cause any automatic charge when it ends.
A Premium subscription begins only after the user separately confirms a purchase through Apple. If Apple configures an introductory offer for an available subscription, its eligibility, duration and subsequent billing terms are shown before purchase. Availability of an offer is not guaranteed.
14. Automatic Renewal
Premium is an auto-renewable subscription.
Unless cancelled before renewal is processed, the subscription renews automatically for another subscription period at the price communicated through Apple.
Payment is charged to the user’s Apple Account.
Apple manages:
billing;
renewals;
introductory-offer eligibility, where configured;
payment failures;
subscription status;
cancellations;
refunds.
MTB TrailRadar does not receive or store the user’s complete payment-card information.
15. Managing or Cancelling a Subscription
Users may manage or cancel their subscription through their Apple Account subscription settings.
Cancelling prevents future automatic renewals but does not normally terminate access immediately. Premium access generally remains available until the end of the already paid subscription period, subject to Apple’s rules and verified entitlement status.
Deleting MTB TrailRadar does not automatically cancel an active subscription.
Users remain responsible for cancelling through Apple’s subscription-management system.
16. Restoring Purchases
Users may use the Restore Purchases function within the app to ask StoreKit to restore eligible Premium access associated with their Apple Account.
Restoration depends on:
Apple’s transaction records;
the Apple Account currently in use;
network and App Store availability;
the status of the subscription.
We cannot manually create or restore an Apple subscription outside Apple’s purchase system.
17. Refunds
Purchases and subscription payments are processed by Apple.
Refund requests must normally be submitted to Apple and are handled according to Apple’s policies and applicable law.
Nothing in these Terms limits any refund, cancellation or consumer right that cannot lawfully be excluded.
18. Third-Party Services
MTB TrailRadar may rely on third-party services or technologies including:
Apple Maps;
MapKit;
Core Location;
StoreKit;
Apple WeatherKit;
external map applications;
external websites or tutorial resources;
email applications.
We do not control the availability, accuracy, security or terms of third-party services.
Use of a third-party service may be subject to that provider’s own terms and privacy policy.
The inclusion of a link or integration does not constitute a guarantee or endorsement of all third-party content.
19. Internet and Device Requirements
Some MTB TrailRadar functionality may require:
a compatible Apple device;
a supported operating-system version;
an internet connection;
enabled location services;
access to Apple or third-party services.
Users are responsible for:
their device;
internet or mobile-data charges;
operating-system updates;
device security;
permissions required for optional functionality.
The app may continue to offer reduced functionality when location, notifications or internet access are unavailable.
20. Availability and Service Interruptions
We aim to keep MTB TrailRadar functional and available but do not guarantee uninterrupted or error-free operation.
Temporary or permanent interruptions may result from:
maintenance;
software updates;
technical failures;
network problems;
third-party service outages;
discontinued APIs;
weather-provider limitations;
security requirements;
legal or regulatory changes;
circumstances beyond our reasonable control.
We may temporarily limit a feature when reasonably necessary to maintain security, reliability, legal compliance or app functionality.
21. Updates and Compatibility
MTB TrailRadar may be updated to:
add or improve features;
correct errors;
maintain compatibility;
address security issues;
comply with legal or App Store requirements;
adapt to third-party service changes.
Some updates may require a newer operating-system version or compatible hardware.
We do not guarantee perpetual compatibility with every device, operating-system version or third-party service.
Material changes affecting paid functionality will be handled in accordance with applicable consumer law and Apple’s requirements.
22. Acceptable Use
Users must not:
reverse engineer, decompile or attempt to extract source code except where expressly permitted by applicable law;
interfere with the normal operation or security of the app;
use the app to violate laws or third-party rights;
attempt unauthorized access to systems or services;
misuse external services accessed through the app;
reproduce, resell or commercially redistribute the app without permission;
remove copyright, trademark or attribution notices.
Users may not reverse engineer the WeatherKit APIs or Apple Weather Data for any purpose.
Nothing in this section restricts rights expressly granted by mandatory law or applicable open-source licences.
23. Intellectual Property
MTB TrailRadar, including its:
software;
design;
text;
graphics;
brand elements;
scoring logic;
original databases and curated content;
is owned by or licensed to the service provider, except for third-party content and technologies.
These Terms grant users a limited, personal, non-exclusive, non-transferable and revocable licence to use the app for its intended purpose, subject to applicable Apple terms.
No ownership rights are transferred to the user.
24. Disclaimer of Warranties
To the maximum extent permitted by applicable law, MTB TrailRadar is provided on an “as is” and “as available” basis.
We do not warrant that the app will:
always be available;
be free from errors;
meet every user requirement;
provide perfectly accurate conditions or forecasts;
prevent accidents or unsafe decisions;
remain compatible with all devices or services.
Nothing in these Terms excludes warranties, guarantees or consumer rights that cannot legally be excluded.
25. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for losses or damage arising from:
reliance on estimated trail or weather information;
riding decisions;
injuries or accidents;
trail closures or access restrictions;
equipment failure;
inaccurate or unavailable third-party data;
service interruptions;
loss of locally stored content;
indirect, incidental or consequential losses.
Users remain responsible for independently assessing riding conditions and risks.
However, nothing in these Terms excludes or limits liability:
for fraud or fraudulent misrepresentation;
for wilful misconduct or gross negligence where it cannot be excluded;
for death or personal injury caused by negligence where exclusion is prohibited;
for breach of mandatory consumer rights;
in any other circumstance where limitation is prohibited by applicable law.
26. Indemnity
To the extent permitted by applicable law, users agree to be responsible for claims or losses arising from their unlawful misuse of the app or violation of third-party rights.
This provision does not apply where prohibited by consumer-protection law and does not impose liability for ordinary good-faith use of MTB TrailRadar.
27. Suspension, Withdrawal and Termination
Because MTB TrailRadar does not require a user account, we do not normally suspend individual user accounts.
We may nevertheless:
discontinue distribution of the app;
withdraw or replace a feature;
stop supporting an operating-system version;
disable functionality that creates a legal, security or technical risk;
end future availability of a subscription product.
Any withdrawal or material modification of paid functionality will be handled subject to:
the user’s existing subscription rights;
Apple’s subscription system;
applicable consumer law.
Users may stop using MTB TrailRadar at any time and may delete the application from their device.
Deleting the application does not automatically cancel an active subscription.
28. Privacy
Use of MTB TrailRadar is also governed by the MTB TrailRadar Privacy Policy.
The Privacy Policy explains:
what information is processed;
what remains locally on the device;
how location and weather requests are handled;
how subscription information is processed;
how users may contact us regarding privacy and how support communications are retained for a maximum of 12 months after a request is closed, unless longer retention is needed for legal obligations or claims.
The Privacy Policy is available through the app and at:
https://www.furbotechlabs.com/mtb-trailradar/privacy/
29. Changes to These Terms
We may update these Terms to reflect:
changes to the app;
changes to Premium functionality;
legal or regulatory requirements;
Apple requirements;
security or technical developments.
The updated Terms will be made available through the app, the App Store listing or the official website.
Where required by applicable law, users will receive appropriate notice before a material change takes effect.
Continued use after the effective date of an update constitutes acceptance only to the extent permitted by applicable law.
Changes will not retroactively remove mandatory rights already acquired by users.
30. Governing Law and Consumer Rights
These Terms are governed by Italian law, without prejudice to any mandatory consumer-protection laws applicable in the user’s country of residence.
Users residing in the European Economic Area, the United Kingdom or another jurisdiction with mandatory consumer protections retain all rights that cannot be excluded or limited by contract.
Nothing in these Terms requires a consumer to waive access to a court or authority that has jurisdiction under applicable law.
31. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply.
The invalid provision will be interpreted or replaced only to the minimum extent necessary to make it lawful and enforceable.
32. No Waiver
Failure to enforce a provision of these Terms does not constitute a waiver of that provision or of the right to enforce it later.
33. Entire Agreement
These Terms, the Privacy Policy and the applicable Apple terms constitute the agreement governing use of MTB TrailRadar.
They replace previous statements concerning the same subject, except for rights that cannot legally be waived or modified.
